    Reporting of Claim by Employer

Reporting of Claim by Employer LE 9-707

If an accident occurs to an employee that results in disability for a period of more than 3 days, it is the responsibility of the employer to report this accident to the Workers' Compensation Commission on a "First Report of Injury" form within 10 days after notice of such accident, whether oral or written.

The employer/insurer must complete the online form and electronically submit it to the Workers' Compensation Commission by selecting the Submit button on the electronic form. You may print/save the completed form after submission. An email address is required to submit the form. A receipt of form or notice of failure will be sent to the email address entered on the form.

    June 2014 Notices

Effective July 1, 2014, when a First Report of Injury (FROI) is filed with the Workers' Compensation Commission, the Commission, will provide the FROI data to the Maryland Division of Labor and Industry (L&I). The Employer/Insurer will no longer be required to submit a duplicate copy of the FROI to L&I.

Note: SB 130 - Effective 7/1/14 amends LE 9-707 adding the following:

    (d) Electronic access. -- The Commission shall provide the Commissioner of Labor and Industry with electronic access to the data contained in the reports filed under subsections (a) and (b) of this section.

    Posting Requirements

    Posting Requirements

All posters or notices prepared and mailed by the Workers' Compensation Commission that give instruction or information about workers' compensation shall be posted in a conspicuous place at the work site. Rule 14.09.01.03

The MD WCC Employers' Posting Notice is 8.5" X 14" and MUST be printed on 8.5" X 14" (legal size) goldenrod or yellow paper. Laser printer or clear photocopier versions are recommended for printed durability and legibility. Default resolution for this printing is 600 dpi (dots per inch). The statutory requirement is "as provided by the MD WCC", hence reduced size or otherwise altered reproductions from the original/default specifications will not constitute statutory compliance.

    Physician Selection

    Physician Selection

In Maryland, medical providers can be selected by the injured worker; however, if they cannot find a medical provider in their area who is willing to provide medical treatment (who is willing to accept the rules of the Medical Fee Guide), it is often suggested that parties should consider contacting the employer/insurer for suggestions for medical providers in their area (the insurer is most likely to have data listing participating medical providers in the various regions of the State, based on their payment records).

There is no formal procedure for change of physician.

    Injured Worker Guide

The worker's compensation system can be complicated, and each state has its own laws regarding workers' compensation.

The information contained in your state's guide provides a general guide for workers injured or made ill on the job.

This state-issued publication will assist you in navigating the workers' compensation system and serve as a resource for basic legal rights as well as steps to take to initiate workers' compensation benefits, deadlines and who to contact for additional assistance.

If you have questions about the workers' compensation process, this guide will provide the contact information for the regulatory agency for your state. In addition, many states have an ombudsman to oversee and assist all interested parties in the workers' compensation system.
