Penalties for Late Reporting 9-1102
An employer who knowingly fails to report an accidental personal injury within the time required is guilty of a misdemeanor and on conviction is subject to a fine not exceeding $500.
The WCIO has updated the Injury Description Tables that are used to reflect specific coding in response to COVID-19.
The WCIO approved the addition of a new Cause Code of 83 for Pandemic and a new Nature Code of 83 for COVID-19. The WCC will begin accepting these codes beginning 4/1/20 and are anticipated to be used for the reporting for any claim effective December 2019 or later.
Posting Requirements
All posters or notices prepared and mailed by the Workers' Compensation Commission that give instruction or information about workers' compensation shall be posted in a conspicuous place at the work site.
The MD WCC Employers' Posting Notice is 8.5" X 14" and MUST be printed on 8.5" X 14" (legal size) goldenrod or yellow paper. Laser printer or clear photocopier versions are recommended for printed durability and legibility. Default resolution for this printing is 600 dpi (dots per inch). The statutory requirement is "as provided by the MD WCC", hence reduced size or otherwise altered reproductions from the original/default specifications will not constitute statutory compliance.
Physician Selection
In Maryland, medical providers can be selected by the injured worker; however, if they cannot find a medical provider in their area who is willing to provide medical treatment (who is willing to accept the rules of the Medical Fee Guide), it is often suggested that parties should consider contacting the employer/insurer for suggestions for medical providers in their area (the insurer is most likely to have data listing participating medical providers in the various regions of the State, based on their payment records).
There is no formal procedure for change of physician.
Reporting of Claim by Employer 9-707
If an accident occurs to an employee that results in disability for a period of more than 3 days, it is the responsibility of the employer to report this accident to the Workers' Compensation Commission on a "First Report of Injury" (FROI/SF1) IAIABC 1-1 through CompHub portal, if registered.
A First Report of Injury (FROI) must be filed by the employer/insurer with the Workers' Compensation Commission. In accordance with COMAR 14.09.01.02 ' Commission Forms, the Commission only accepts the FROI form prepared by and issued by the Commission, form IA-1 (r 1-1-02)
June 2014 Notices
Effective July 1, 2014, when a First Report of Injury (FROI) is filed with the Workers' Compensation Commission, the Commission, will provide the FROI data to the Maryland Division of Labor and Industry (L&I). The Employer/Insurer will no longer be required to submit a duplicate copy of the FROI to L&I.
Note: SB 130 - Effective 7/1/14 amends LE 9-707 adding the following:
(d) Electronic access. -- The Commission shall provide the Commissioner of Labor and Industry with electronic access to the data contained in the reports filed under subsections (a) and (b) of this section.
