    Penalties for Late Reporting

    Penalties for Late Reporting 65.2-902  

    Any employer, insurance carrier, self-insurer, group self- insurance association, or third party administrator who fails to make any report required by the Commission will be assessed a civil penalty up to $500 for each failure. If the Commission determines that the failure is willful, it will assess a civil penalty of $500 to $5,000. 

    Physician Selection

    Physician Selection 65.2-603

    The employee must select a doctor from a panel of three physicians provided by the employer/carrier. If a panel is not offered after notice of the accident, the employee may seek treatment from any physician. The treating physician may refer the employee to other doctors. Once treatment begins, the physician cannot be changed without approval of the employer/carrier or after a hearing by the Commission. The employee must cooperate with medical treatment or the weekly benefits may be suspended.

    Employers must conspicuously post a workers’ compensation notice (Spanish Version)) indicating their compliance with the Act.

     

     

    Reporting of Claim by Employer

    A report of an accident or disease must be filed with the Commission within 10 days of knowledge of the accident or disease. The employer should immediately notify its insurance carrier about the accident, and the insurance carrier will then file the appropriate reports with the Commission.
